Terms of Service

Last updated: November 3, 2026

These terms are an agreement between you and DuesIQ LLC ("DuesIQ," "we" or "us"). They apply when you use duesiq.com, the DuesIQ phone app, or any page DuesIQ runs for your HOA. By creating an account or using DuesIQ, you agree to them. If you don't agree, please don't use DuesIQ.

Read the section called "Settling disputes." It says most disputes go to individual arbitration instead of court, and it explains how to opt out.

What DuesIQ is

DuesIQ is software that homeowners associations (HOAs) use to bill dues, take payments, keep their books, run votes, take amenity bookings, and keep in touch with residents. DuesIQ provides the software. We are not your HOA, a property manager, a bank, a lawyer or an accountant.

Your HOA makes the decisions

Your HOA's board decides what each home owes, sets the fees, fines and rules, approves or denies requests, and keeps the records for your home. DuesIQ shows and collects what your HOA enters. If you disagree with an amount, a charge, a fine, a vote result or any other HOA decision, take it up with your board. DuesIQ can't change your HOA's decisions and isn't responsible for them.

Your HOA's agreement with DuesIQ

Each HOA that uses DuesIQ signs its own subscription agreement with us. That agreement controls the relationship between your HOA and DuesIQ. These terms control your own use of DuesIQ as a resident, board member or visitor.

Your account

  • You must be at least 18, or have a parent or guardian agree to these terms for you.
  • Give true information and keep it up to date.
  • Keep your password and sign-in codes to yourself. You are responsible for what happens under your account.
  • Tell us right away at support@duesiq.com if you think someone else got into your account.
  • Board members must use two-step sign-in.

Payments

When you pay dues, fees, deposits or bookings in DuesIQ, the money goes to your HOA. Payments are processed by Stripe, and Stripe's terms also apply to them. DuesIQ is not a bank and does not hold your money.

Your HOA may charge a processing fee for some payment types, like cards. Any fee is shown before you pay.

Autopay. When you turn on autopay, you authorize your HOA, through DuesIQ and Stripe, to charge the card or bank account you chose for each amount your home owes when it comes due, until you turn autopay off. You can turn it off any time in DuesIQ. Turning it off stops future charges; it doesn't cancel a payment that has already started.

Refunds and returned payments. Your HOA decides refunds under its own rules. If a payment is returned or disputed, your HOA may charge a returned-payment fee under its rules, and the amount goes back on your home's account.

Estoppel certificates. Title companies, closing agents and others can request an estoppel certificate on an HOA's request page in DuesIQ. Before paying, the page shows the certificate fee and any card or bank fee. When the HOA charges a delinquent account fee, the page also shows that fee and the total if the account for the property is delinquent, and the requester checks a box agreeing to it. When the requester presses Confirm and pay, DuesIQ checks the HOA's records for that property and charges the total that applies, once, as a single payment. The delinquent account fee is part of the price the requester agreed to before paying. It is not a separate or later charge.

What you post

You keep ownership of what you post or upload, like messages, bulletin posts, photos and documents. You give DuesIQ permission to store it, show it to the people in your HOA who are meant to see it, and use it to run DuesIQ for your HOA.

Don't use DuesIQ to:

  • harass, threaten or bully anyone;
  • post anything illegal, hateful, sexual, or that shares someone else's private information;
  • pretend to be someone else, or get into accounts or data that aren't yours;
  • send spam, or try to break, overload or copy DuesIQ.

Anyone can report a bulletin post or block another resident. Your HOA and DuesIQ may remove anything that breaks these terms, and we may suspend or close accounts that do.

AI tools

Some DuesIQ tools use outside AI to read documents, sort bank charges, draft text and answer questions. AI can be wrong. Check its work before you rely on it, especially for money or legal matters. Our privacy policy explains what these tools send and how to turn them off.

The phone app

The DuesIQ app is licensed to you, not sold, for your personal use on devices you own or control, under these terms. If you got the app from the Apple App Store, these terms are between you and DuesIQ, not Apple. Apple is not responsible for the app or its content, has no duty to support or maintain it, and is not responsible for any claims about it, including product liability claims, claims that it doesn't meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone else's rights. DuesIQ handles those. If the app fails to work as promised, you may tell Apple, and Apple may refund the purchase price, which is $0. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not in a country under a U.S. embargo and not on a U.S. government list of restricted parties. Google Play's terms also apply if you got the app from Google Play.

Changes and availability

We work to keep DuesIQ running, but we can't promise it will always be available or free of errors. We may change, add or remove features. Our status page shows whether DuesIQ is up.

Ending your use

You can stop using DuesIQ and delete your account any time in Settings, under Security. Your HOA keeps its records for your home, as our privacy policy explains. We may suspend or close an account that breaks these terms, or that your HOA removes. If your HOA stops using DuesIQ, your access to that HOA in DuesIQ ends too.

No warranties

DuesIQ is provided "as is" and "as available." To the fullest extent the law allows, we make no promises about DuesIQ beyond what these terms say, and we disclaim all implied warranties, including that it is fit for a particular purpose, merchantable, accurate, or will work without interruption. We don't check, and are not responsible for, the amounts, rules, decisions or content your HOA or other users put into DuesIQ.

Limits on our liability

To the fullest extent the law allows, DuesIQ and the people who work for it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or the cost of replacement services, even if we were told they might happen.

Our total liability to you for all claims about DuesIQ is limited to the greater of $100 or the amount you paid directly to DuesIQ in the 12 months before the claim. Money you pay to your HOA through DuesIQ, like dues and fees, is paid to your HOA, not to DuesIQ.

Some states don't allow some of these limits. Where they don't, these limits apply only as far as the law allows. Nothing here limits liability that the law says can't be limited.

Your responsibility

If someone makes a claim against DuesIQ because of what you posted, or because you broke these terms or the law while using DuesIQ, you agree to cover DuesIQ's reasonable costs of that claim, including lawyers' fees.

Settling disputes

Talk to us first. If you have a problem with DuesIQ, email support@duesiq.com and describe it. We'll try to work it out within 30 days. Disputes about your HOA's amounts or decisions are between you and your HOA.

Arbitration. If we can't work it out, you and DuesIQ agree to settle any dispute about DuesIQ or these terms by binding individual arbitration, run by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us may instead bring a claim in small claims court if it qualifies. Either of us may also ask a court to stop someone from misusing DuesIQ or its software.

No class actions. You and DuesIQ may only bring claims individually, not as a plaintiff or class member in a class, group or representative action.

You can opt out. To keep your right to go to court, email support@duesiq.com within 30 days after you first agree to these terms, with your name, the email on your account, and the words "arbitration opt-out."

Law and courts. These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute that goes to court (because you opted out, or the arbitration terms don't apply) will be heard in the state or federal courts located in Jackson County, North Carolina.

Other terms

  • We may update these terms. We'll post the new version here and change the date at the top. For a big change, we will also tell you in DuesIQ or by email before it takes effect. Using DuesIQ after that means you accept the change.
  • If one part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a term right away, we can still enforce it later.
  • You can't transfer these terms to someone else. We may transfer them if DuesIQ is sold or merged.
  • These terms, our privacy policy and our cookie policy are the whole agreement between you and DuesIQ about your use of DuesIQ.
